
Recent Win $113 Million Verdict Awarded to Missouri Corrections Workers
On August 15th, 2018, a Cole County jury rendered a verdict for a class of Missouri Corrections officers against the Missouri Department of Corrections in the amount of $113,714,632.00. This was slightly over what lead trial attorney Gary Burger of Burger Law requested from the jury. Many thanks to the Cole County court personnel and the jury for their hard work and time devoted to the case.
Types of Injury Claims
Accidental claims typically rest on the legal theory of negligence. This allows people who suffered injuries due to someone’s carelessness to ask for compensation for their injuries. In most cases, a plaintiff must prove that the defendant owed them a duty to care for their well-being. They then must demonstrate that actions taken by the defendant breached this duty and caused their injuries.
Cases can also rely upon a theory that the defendant failed to act to protect the plaintiff. For example, hotels have a duty to protect all guests. If a guest is assaulted or burgled on the property, the hotel may be found negligent by a St Louis accident attorney in failing to provide adequate security.
